Combine woman's manslaughter charge upgraded to murder with grand jury indictment

COMBINE, Texas — A Kaufman County grand jury has handed down a murder indictment for a Combine-area woman arrested earlier this year on a manslaughter charge.

COMBINE, Texas — A Kaufman County grand jury has handed down a murder indictment for a Combine-area woman arrested earlier this year on a manslaughter charge.

On Wednesday, June 7, 2023, the Kaufman County Sheriff's Office responded to a residence at 223 Davison Road in the Combine area of Kaufman County in reference to a shooting.

According to a search warrant affidavit, obtained by inForney.com, 39-year-old Kiali Robyn Herrington told police she and Brandon Clark had gone out to dinner earlier in the evening, then to a park. There, Herrington told police she and Clark had a verbal argument, in which he accused her of cheating on him while he was recently incarcerated.

"...as they arrived back home, she closed the door locking [Clark] outside of the residence," reads the affidavit, in part. "...[Clark] kicked the front door in an attempt to gain entry inside of the residence, before going around to the back of the residence where he removed a window unit air conditioner from the window."

Clark then entered the residence where Herrington tells police he began to verbally threaten her.

"Deputies advised the suspect informed she fired one gunshot from a .380 handgun into the ceiling before firing another shot shooting the victim," reads the affidavit.

Clark was transported by EMS to the Combine Fire Station and subsequently airlifted to Methodist Hospital in Dallas, Texas, where he succumbed to his injuries.

According to the return and inventory of the search warrant, investigators only recovered one shell casing and took digital photographs and measurements of the scene.

The indictment, entered into county record on September 8, 2023, alleges Herrington, on June 7, 2023, did "intentionally and knowingly cause the death of an individual, namely, Brandon Clark, by shooting him."

According to Kaufman County records, Herrington had previously been released on a $500,000 bond in the case, was booked on the new charge, and released on original bond conditions.

The first hearing announcement in the case is scheduled for November 9, 2023, before Kaufman County 86th District Court Judge Casey Blair.
