On Saturday, February 20, 2016, at approximately 6 p.m., two of the men were arrested after the Forney Police Department received a 911 call about two male subjects in the Walmart parking lot attempting to change a flat tire on a vehicle which appeared to have sustained major front end damage, according to an incident report obtained by inForney.com.
The 911 caller stated the individuals appeared to be intoxicated and one appeared to have whip cream on his face.
Police arrested 63-year-old Burney Ray Shelton of Dallas, Texas, and 37-year-old Jason Frank Pendergrass of Cedar Hill, Texas, impounded two vehicles, and seized 2.44 grams of heroin, 8.79 grams of hallucinogens, and 4.6 grams of depressants.
Pendergrass was charged with possession of a controlled substance penalty group 1 greater than or equal to one gram and less than four grams on a $15,000 bond, possession of a controlled substance penalty group 2 greater than or equal to four grams and less than 400 grams on a $30,000 bond, possession of a controlled substance penalty group 3 less than 28 grams on a $2,500 bond, and prohibited substance or item in a correctional facility on a $15,000 bond.
Shelton was charged with possession of a controlled substance penalty group 1 less than a gram and possession of marijuana less than two ounces. He has since been released from the Kaufman County Jail.
Also on Saturday, just after 3 p.m., 46-year-old Joseph Franklin Chastain of Dallas, Texas, was arrested and charged with possession of a controlled substance penalty group 1 greater than or equal to one gram and less than four grams on a $50,000 bond, theft of a firearm on a $25,000 bond, and seven outstanding warrants out of Dallas, Balch Springs, and Wilmer.
Police seized a stolen Kimber Ultra Crimson handgun and 1.25 grams of meth, according to a Forney Police Department incident report for Chastain’s arrest.
50-year-old Andrew Grubbs was also arrested over the weekend following a traffic stop on U.S. Highway 80. Grubbs was charged with possession of a controlled substance penalty group 1 greater than or equal to one gram and less than four grams on a $75,000 bond, and possession of marijuana less than two ounces on a $5,000 bond.
According to court records, Grubbs’ criminal history includes convictions for possession of cocaine, possession of marijuana, possession of a dangerous drug, possession of amphetamine, unauthorized use of a motor vehicle, burglary of a vehicle, burglary of a habitation, aggravated robbery with a deadly weapon, theft of property, evading arrest or detention with a vehicle, and possession of a controlled substance penalty group 1. The convictions stem back to 1985 from Benbrook, Johnson County, White Settlement, Fort Worth, Garland, Mesquite, and Dallas.
