FORNEY, Texas – A Kaufman County grand jury found there was not sufficient evidence to indict former Baylor University football player Krystopher Thomas Buerck in the shooting death of his friend 23-year-old William Franklin Trimble III in Forney.

The grand jury no billed Buerck, now 25 years old, on Friday afternoon, September 12, 2014 – just a week shy of the two year anniversary of the shooting. The shooting incident occurred back on September 17, 2012, as previously reported by inForney.com.

Just after 4 a.m., Forney police officers responded to Buerck's home in the 100 block of Trailwood Court after receiving a 911 call about a disturbance with shots fired. Upon their arrival, officers made contact with Buerck outside his home and located Trimble inside the home lying on the floor with several gunshot wounds. Trimble was taken to an area hospital and later died of his injuries.

Buerck was taken to the Forney Police Department that night for questioning and was released later the same morning at approximately 10:45 a.m. A police report at the time of the incident listed the death as a justifiable homicide.

Both Buerck and Trimble were Mesquite High School graduates.

This continues to be a developing story. A request with the Dallas County Medical Examiner's Office for Trimble's autposy report was made by inForney.com on Monday. A request for the Forney Police Department's full incident report was also made Monday. A partial incident report has been released. The full release is pending disposition notice from the Kaufman County District Attorney's Office.
