Murder charge filed after man dies from injuries sustained in assault

MABANK, Texas — A murder charge was filed Thursday against a man accused of assaulting another man last month who later died of complications from injuries sustained in the assault.

MABANK, Texas — A murder charge was filed Thursday against a man accused of assaulting another man last month who later died of complications from injuries sustained in the assault.

According to Kaufman County Jail records, 56-year-old Roy Dwayne Toney is now charged with murder in the death of 52-year-old Larry Suratt of Mabank, Texas. Toney’s bond on the murder charge is set at $500,000.

On June 29, 2015, Suratt was mowing at his mother’s home on County Road 4012 in southeastern Kaufman County when police say Toney arrived to also work at the property.

The two became involved in a dispute in which Toney allegedly ran over Suratt with his truck and trailer.

Toney’s truck and trailer became wedged in between two trees as he attempted to flee the scene and that’s when Suratt’s mother, reportedly in her 70s, shot Toney in the leg with a shotgun, Kaufman County Sheriff’s Office Captain Fred Klingelberger told inForney.com the day of the shooting.

Toney was treated for his injuries and booked into the Kaufman County Jail — initially charged with aggravated assault with a deadly weapon.

Suratt was taken to the hospital and suffered a broken nose, broken femur, broken rib, broken pelvis, and other medical issues which required several surgeries, according to neighbor Bill Hartzer. Suratt remained at the hospital until he died of complications related to those injuries on July 7, 2015.

A Kaufman County judge issued the murder warrant on Thursday, July 16, 2015.
