Jury selected in Patton intoxication manslaughter trial

KAUFMAN COUNTY, Texas – 12 jurors were selected Monday afternoon to decide the case of Warren Ray Patton Jr., the Kaufman County man accused of the intoxication manslaughter death of off-duty Dallas County Constable Guy Farley in 2012.

KAUFMAN COUNTY, Texas – 12 jurors were selected Monday afternoon to decide the case of Warren Ray Patton Jr., the Kaufman County man accused of the intoxication manslaughter death of off-duty Dallas County Constable Guy Farley in 2012.

Approximately 71 of the 250 summoned jurors appeared for voir dire this morning at the Kaufman County Courthouse. The 12 jurors were selected just after 4 p.m.

Patton is facing a two count indictment for intoxication manslaughter and manslaughter for a June 9, 2012, accident on Farm-to-Market (FM) 741 where Patton allegedly drove his BMW across the center line of the road and struck Farley's Chevy Silverado head-on – which resulted in Farley's death.

Following the seven hour voir dire process, Kaufman County 422nd District Court Judge B. Michael Chitty held a “Daubert” hearing, under Rule 702 of the Federal Rules of Evidence, to determine the admissibility of blood and urine test results from Parkland Hospital.

The court heard from two witnesses from Parkland Hospital, an orthopaedic surgeon and a clinical laboratory specialist, concerning the state of Patton while at the hospital and the results of the blood and urine tests. Recess was called at 6:20 p.m. and a ruling is expected to be made before the beginning of the trial tomorrow morning.

Trial, which is expected to last five days, will resume at 9 a.m. in the 422nd District Court.
