A Kaufman County Grand Jury indicted Warren Ray Patton Jr., 32, of Kaufman, for intoxication manslaughter with a vehicle on December 6, 2012. On June 9, 2012, Patton drove his BMW into opposing traffic on FM 741 striking off-duty Dallas County Deputy Constable Guy Farley's Chevy Silverado.
Deputy Constable Farley died at the scene of the accident and Patton was taken to Parkland Memorial Hospital with non-life threatening injuries.
According to Kaufman County Assistant District Attorney Mark Hasse, drugs and alcohol played a role in the accident. Patton's blood alcohol level upon arriving at Parkland was .086 and a series of drugs were found in his system including hydrocodone, Xanax, diazepam (Valium), and nordiazepam (muscle relaxant).
On June 28, 2002, Patton was convicted of the offense of driving while intoxicated and has previously been charged with possession of a controlled substance, possession of marijuana under two ounces, and possession of drug paraphernalia.
Guy Farley lived in the Heartland addition off of FM 741 in Forney. He was married and had two daughters, one of whom is only four years old. On the night of the accident, Farley and his wife took their youngest daughter to her dance recital and then returned home. He then went to the Crandall Whataburger to pick up a late meal. The accident occurred on his way home, just four miles from his house.
If convicted, Patton could serve 2-20 years and be fined up to $10,000.
