Balch Springs City Manager Contract Reinstated For Five Years - $27k Annual Pay Increase, City Vehicle

BALCH SPRINGS - Charles Fenner, the Balch Springs City Manager charged with Driving While Intoxicated, has been reinstated with a five-year contract, a $27k annual salary increase, and a city vehicle with the city's logo.

In Fenner's third amended employment contract obtained by InForney.com, Fenner has an employment agreement with Balch Springs for five years.

"As compensation for Employee's services under this Agreement, Employer shall pay, and Employee shall accept a base salary of $230,000.00," states the contract. "As a Cost-of-Living Adjustment (COLA), Employees base salary shall be automatically increased annually throughout the term of this Agreement in the amount of $6,900."

In addition, Fenner will receive 20 vacation days annually, professional memberships, and professional conferences within his budget.

Furthermore, Fenner will also be provided a city vehicle with the city's logo on it.

"Employee shall be issued a vehicle for his use in performing his duties under the term of this Agreement, including, without limitation, a take-home car marked with City of Balch Springs logo," states Article III (g) of the employment agreement.

On November 7, 2023, Fenner was arrested in Kaufman County and charged with Driving While Intoxicated. Furthermore, records previously obtained by inForney.com show that Fenner was also detained in Terrell in July of 2022 for Driving While Intoxicated/Open Alcohol Container.

The third amended agreement also requires mandatory drug testing, which "shall be conducted by the City's Human Resources Department on a quarterly basis through the final disposition of Employee's pending criminal case or for one year, whichever occurs first."

One resident who wishes to remain anonymous hopes the HR Director will administer the tests outlined in the contract for public transparency and accountability.

The question remains: If Fenner is convicted of his charges and sentenced, will the City of Balch Springs have to pay out his contract?
